Apple's Standard EULA

On This Holiday is developed and provided by Ian Clawson ("On This Holiday," "we," "us," or "our"). Your license to use the On This Holiday iOS app is governed by Apple's Standard Licensed Application End User License Agreement (the "Standard EULA"). These Terms of Use provide supplemental terms for the app and website. If these Terms conflict with the Standard EULA, the Standard EULA controls.

Using On This Holiday

On This Holiday provides informational and entertainment content about holidays, observances, historical events, celebration ideas, and related subjects. You may use the app and website for lawful personal purposes in accordance with these Terms, the Standard EULA, and applicable Apple platform rules.

You may not misuse the app or website, interfere with their operation or security, attempt to gain unauthorized access, or use them in a way that violates applicable law or the rights of another person.

Informational content

Holiday dates, histories, descriptions, classifications, suggestions, and other content may change, differ by source or location, or contain errors. Content is provided for general informational and entertainment purposes and is not professional, legal, financial, medical, safety, or other expert advice. You are responsible for deciding whether an activity or suggestion is appropriate for your circumstances.

Deals and third-party services

The app may help you search for promotions or open websites, maps, articles, or other services operated by third parties. We do not sell the products or services displayed by third parties, and we do not guarantee that a deal, price, promotion, location, link, or third-party service is accurate, available, safe, or suitable. Your dealings with a third party are between you and that third party and are subject to its own terms and privacy practices.

Subscriptions and purchases

On This Holiday may offer monthly and annual auto-renewable subscriptions and, while available, a one-time lifetime purchase. The products, localized prices, subscription periods, trial eligibility, and included features presented in the app at the time of purchase are part of these Terms.

If an eligible annual subscription includes a seven-day free trial, payment will be charged to your Apple Account when the trial ends unless you cancel at least 24 hours before the end of the trial. Auto-renewable subscriptions renew and your Apple Account is charged unless you cancel at least 24 hours before the end of the current subscription period. You can manage or cancel a subscription in your Apple Account subscription settings. Deleting the app does not cancel a subscription.

Apple processes all App Store purchases and controls billing, cancellation, and refund procedures. We do not receive your complete payment-card information. Trial eligibility and refund decisions are determined by Apple under its applicable rules. You can use Restore Purchases in the app to restore eligible purchases associated with your Apple Account.

We may change which products are offered to new customers. Removing the lifetime purchase from sale does not convert an existing valid lifetime purchase into a subscription. Access remains subject to the Standard EULA, continued compatibility of the app and operating system, and any circumstances in which Apple revokes or refunds a transaction.

Changes to the service

We may update, correct, add, remove, or discontinue content and features over time. We do not promise that every feature, holiday, external link, or service will remain available indefinitely. Any changes remain subject to applicable law, the Standard EULA, and your rights concerning paid content for the applicable purchase or subscription period.

Intellectual property

The app, website, software, visual design, branding, and original content are owned by Ian Clawson or used with permission and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of that material to you. Rights in third-party names, marks, images, websites, and content remain with their respective owners.

Privacy

Our Privacy Policy explains how the app and website handle information and is incorporated into these Terms by reference.

Disclaimers and liability

The disclaimers, warranty terms, and limitations of liability in Apple's Standard EULA apply to the app. To the fullest extent permitted by applicable law and consistent with the Standard EULA, the website and supplemental content are provided "as is" and "as available" without additional warranties. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

Children

On This Holiday is not directed to children under 13. If you are not old enough to agree to these Terms under the law where you live, a parent or legal guardian must review and agree to them on your behalf.

Changes to these Terms

We may update these Terms to reflect changes to the app, website, or applicable law. We will post revised Terms here and update the effective date. Your continued use after an update means the revised Terms apply to your subsequent use, to the extent permitted by law.
